The legal entity behind the Kunstmuseum Basel is the Öffentliche Kunstsammlung Basel, a public institution under the aegis of the Department of Presidential Affairs of the Canton of Basel-Stadt. The legal framework for its operation is defined by the Law on Museums of June 16, 1999, and the Implementing Regulations of December 19, 2000, which also define the rights and responsibilities of the Board of Trustees.

The Kunstmuseum cooperates with numerous committees, foundations, and associations that support its work in a variety of ways, including the Emanuel Hoffmann Foundation, the Im Obersteg Foundation, the Foundation for the Kunstmuseum Basel, and the Friends of the Kunstmuseum Basel.
